1. Agreement and eligibility
By creating an account, accepting these Terms of Use, or accessing Opinr or Maalob (together, the “Service”), you agree to these terms. If you do not agree, do not use the Service. You must be at least 13 years old and legally able to enter this agreement. If local law requires a higher age or parental consent, that requirement applies.
If you use the Service for an organization, you represent that you have authority to bind that organization. Mandatory consumer rights that apply where you live are not limited by these terms.
2. Accounts and security
You must provide accurate information, protect your credentials and check-in codes, and promptly tell us about suspected unauthorized access. You are responsible for activity under your account except to the extent caused by our failure to use reasonable safeguards.
Opinr identity may be used to sign in to Maalob. An Opinr account and its Maalob safety profile may have separate controls and deletion processes, as described in the Privacy Policy and account-deletion pages.
3. Maalob is not an emergency service
Maalob is a safety-support and communication tool. It is not an emergency service, alarm-monitoring service, medical service, security service, or substitute for contacting local emergency services. If you or another person may be in immediate danger, contact the appropriate emergency service directly.
Maalob can help you schedule check-ins and ask third-party providers to notify trusted contacts. Delivery can be delayed or fail because of internet access, device state, permissions, operating-system restrictions, provider outages, incorrect contact information, filtering, or other circumstances outside our control. Provider acceptance does not prove that a contact received, read, or acted on a message.
You remain responsible for choosing suitable trusted contacts, keeping their information current, maintaining another emergency plan, and deciding when direct help is needed. A reverse-PIN or other discreet signal cannot guarantee a particular outcome or response.
4. Trusted contacts, location, and communications
You may provide trusted-contact details, custom messages, schedules, and optional location. You confirm that you have a lawful basis and any permission needed to provide that information and ask us to contact those people. Do not use the Service to stalk, harass, deceive, threaten, impersonate, or violate another person’s privacy or rights.
If you enable location, it may be saved with a check-in or alert and shared with approved trusted contacts as explained when you use the feature and in the Privacy Policy. Maalob does not promise continuous location tracking.
By enabling email, text-message, or push communications, you request operational messages related to accounts, check-ins, invitations, and safety events. Carrier, messaging, and data charges may apply. You can change available notification choices, but disabling a channel may reduce functionality.
5. Acceptable use
You may not misuse the Service, attempt unauthorized access, interfere with its operation, probe or bypass safeguards, upload malicious code, automate abusive traffic, infringe rights, use the Service unlawfully, or help anyone do so. You may not reverse engineer the Service except where applicable law expressly permits it.
6. Privacy and user content
Our Privacy Policy explains how information is collected, used, shared, retained, and deleted. You retain ownership of content you provide. You grant Opinr a limited right to host, process, transmit, and display that content only as needed to operate, secure, support, and improve the Service and comply with law.
7. License and third-party services
Subject to these terms, Opinr gives you a limited, personal, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose. Opinr and its licensors retain all rights in the Service, including software, designs, trademarks, and content not provided by users.
The Service may depend on third parties such as Apple, Google, Firebase, mapping, network, email, and messaging providers. Their separate terms and privacy practices may apply. For an iOS app obtained through Apple’s App Store, Apple’s Standard Licensed Application End User License Agreement also governs the licensed application to the extent applicable.
8. Changes, availability, and termination
We may maintain, change, suspend, or discontinue features. We aim to give reasonable notice of material changes when practical, but uninterrupted or error-free availability is not promised. We may restrict or terminate access when reasonably necessary to protect users, the Service, or third parties; respond to legal requirements; or address a material violation of these terms.
You may stop using the Service and use the available account-deletion controls. Provisions that by their nature should survive termination—including ownership, disclaimers, limitations, and dispute provisions—remain in effect.
9. Disclaimers and limits
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that alerts or communications will be delivered or acted on. Nothing in these terms excludes a warranty or liability that applicable law does not allow us to exclude.
To the maximum extent permitted by law, Opinr will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities arising from the Service. Opinr’s aggregate liability for claims arising from the Service will not exceed the greater of US $100 or the amount you paid Opinr for the Service during the 12 months before the event giving rise to the claim. These limits do not apply where prohibited by law.
10. Changes to these terms and disputes
We may update these terms. When a change is material, we may provide notice and require acceptance of the new version before further use. The version presented for acceptance governs from the time you accept it. Disputes will be handled by courts with jurisdiction under applicable law, and mandatory rights available in your place of residence remain available.
